Terms Of Service

These Terms of Service ("Terms") govern your use of the RAYKIRI online freelancing platform ("Platform"), provided by RAYKIRI ("we," "our," or "us"). By accessing or using the Platform, you agree to be bound by these Terms.

User Accounts

To access certain features of the Platform, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary to keep it accurate and current.

Expert Profile Listings

Users may create business profile listings on the Platform to advertise their professional services. By creating a business profile listing, you represent and warrant that all information provided is accurate, complete, and up-to-date. You agree to comply with all applicable laws and regulations when creating and managing your listings.

Transactions

Users may engage in transactions through the Platform, such as purchasing services advertised in business profile listings. RAYKIRI is not a party to these transactions and is not responsible for any disputes between users. Users are solely responsible for the content of their listings and the quality of the services provided. All related transaction between a Business user purchasing the services of an Expert and and Expert receiving payment from the Business are handled via Stripe payment gateway. Experts and Business users understand that its soley the responsibility to understand the Fees involved with making a listing (Expert) and purchasing a listing (Business). Cross border related transaction fees for listing purchased different region from the Expert who made the listing will be chared to both Expert and Business user based on International standard banking regulations. Typically this is 1% of the listing price plus a small banking fee, however this may very slighting depending on region. 

Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, and images, are the property of RAYKIRI or its licensors and are protected by copyright and other intellectual property laws. You may not use, copy, reproduce, modify, distribute, or display any part of the Platform without our prior written consent.

Limitation of Liability

To the fullest extent permitted by applicable law, RAYKIRI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; or (c) unauthorized access, use, or alteration of your transmissions or content.

Indemnification

You agree to indemnify and hold harmless RAYKIRI and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

Changes to These Terms

RAYKIRI reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions.
